Commercial Lease Forfeiture London & Oxford
Need to Recover Possession of Commercial Premises?
Ingram Associates are commercial lease forfeiture and enforcement specialists, based on the Strand in Central London with a second office in Oxford, acting for commercial landlords across London, Oxfordshire and the wider UK. With more than forty years’ experience, we help landlords bring a lease to an end and take back possession when a tenant falls into arrears or breaches the terms of the lease.
Timing is critical, so we act fast on instruction. In forfeiture, hesitation can cost you the remedy altogether.
What is Involved in Forfeiting a Commercial Lease?
Almost every commercial lease contains a right of re-entry, entitling the landlord to end the lease if the tenant fails to pay rent or breaches another covenant. Where that right has arisen, it can be exercised in one of two ways: by peaceable re-entry, or by court proceedings.
For rent arrears, peaceable re-entry is usually the fastest and most cost-effective route — certificated enforcement agents attend, typically outside business hours, take possession, change the locks and secure the building, with no court order required. This is available only where the premises are wholly commercial. Where the breach is something other than rent, a formal notice under Section 146 of the Law of Property Act 1925 must be served first, giving the tenant an opportunity to put matters right.
Fast, lawful peaceable re-entry
We attend promptly, often out of hours, to take possession, change the locks and make the premises secure — carried out by experienced, certificated agents, so the property is returned to your control cleanly.
Act quickly to avoid waiver
If you demand or accept rent after becoming aware of a breach, you may waive the right to forfeit for that breach and lose it entirely. The moment you decide to forfeit, stop accepting rent and instruct us without delay. Acting fast is precisely why commercial landlords come to us.
The right route for your breach
Not every situation calls for peaceable re-entry. We advise on whether re-entry or court proceedings is appropriate, on the Section 146 requirements where the breach is not rent-related, and on dealing correctly with any goods the tenant has left behind. Fees depend on the nature of the instruction and are confirmed before we proceed.
