Traveller Evictions Q&A

TOP CLOSED TAB

What approach should I take to evicting travellers from private land?

There are two legally enforceable methods used to evict travellers from private land. You can invoke Common Law powers that enable you to legally take control of your land and evict unwanted trespassers by using reasonable force. Or apply to the court for a Writ of Possession. A Writ of Possession is an order from the High Court demanding that persons unknown (ie the travellers) must vacate the site immediately.

The choice on which method to use to evict travellers from your land depends on the situation, the site and the speed you want eviction to take place. Instruct Ingram Associates today, and we can identify the most efficient and effective traveller eviction approach for you.

Is it legal to evict travellers?

Evicting travellers from private property is legal, but you must follow the correct processes and procedures. As traveller eviction experts, we understand the complex rules, regulations and laws and can manage the process for you.

Once instructed, we’ll go to work on your behalf, identifying the best approach and enforcing it. It’s our job to ensure everything complies with the letter and spirit of the law.

How long will it take to evict travellers from private land?

The time it takes to evict travellers from your land depends on the method we take. If we believe that a Common Law approach is likely to be successful, we can act immediately, issuing a Notice of Intended Eviction within 24 hours. We would recommend giving travellers a reasonable amount of time (24-48 hours) to vacate the site before taking further action.

Applying for a Writ of Possession can be a longer process and far more expensive. However, on sites where there are a considerable number of caravans, this method of eviction can be preferable as the police have a legal obligation to attend the eviction. This approach will require instructing lawyers. However, we work closely with firms experienced in this field who will expedite the legal process.  There are options available to fast-track the process, but there are additional costs.

Each situation is different, so to discuss your available options for evicting travellers from your land, contact us today.

How much does it cost to evict travellers from private land?

Each traveller eviction is different, so it’s impossible to provide a precise cost. The price you pay to evict travellers from your land will depend on the nature of the site, the number of trespassers and how established they are on the land.

If you contact us with some details of your situation, we can provide a detailed quotation that includes:

  • Preparation and service of Notice of Intended Eviction
  • Eviction visit and enforcement (if required)
  • Recovery trucks

We also offer additional services that you may require, including site security and site clean-up.

What information do you need from me to start the traveller eviction process?

To begin the process of evicting travellers from private land, we will ask for some initial information, including:

  • Your name and address (an individual or organisation)
  • Site address
  • Land Owner’s details
  • Name of person or body authorised to give instructions
  • Length of time travellers have been on the site
  • Approximate number of caravans, trailers or vehicles on site

This will provide the information we need to begin the process. We will need to speak with you and may need to perform a risk assessment and site visit, depending on the information you provide us.

What areas do you cover?

We have experience of successful traveller evictions in London, the Home Counties, Oxfordshire, Gloucestershire, Northamptonshire and the West Midlands.

Do you provide traveller evictions for councils?

Travellers have just arrived on my land. What should I do?

Acting swiftly and decisively is critical. Instruct us today, and we can begin the process of evicting travellers from your site. Our site security team can ensure that no further travellers have access to your site, stopping the problem from getting worse.

Is it OK to refer to travellers as gypsies?

The word gypsy has been used as an insult and is a term of racial discrimination. We don’t use the term gypsy eviction, preferring to use traveller instead.

Throughout the traveller eviction process, we remain respectful and polite and avoid causing any unnecessary offence.

While we recognise that the traveller eviction process can be difficult and upsetting for landowners, we find that this approach much more likely to lead to a successful and positive outcome.
